Do I definitely need a Party Wall Agreement?

If you are carrying out work to an existing party wall or shared structure, including a chimney; you intend to build on or close to the boundary line; you are excavating within three metres of a building or structure, or are building further away but excavation is still required, then the Party Wall etc. Act 1996 is likely to come into play and you will need to follow statutory procedure.

Whilst the Party Wall Act does not contain enforcement procedures if you fail to serve notice on adjoining owners, if you start work without a neighbour’s consent then they may seek to halt your work through a court injunction or other legal channels. So you really are best advised to take advice before you start.

If you opt to self-file your Party Wall Notice, or use an unregulated party to take care of this important responsibility, you are risking spending more money down the line if the notices are incorrectly issued and need to be corrected. The fact is that the vast majority of self-filed notices will carry some form of inaccuracy, which translates as a false economy.

Party wall surveyors who are accredited by the Royal Institute of Chartered Surveyors (RICS) are liable for any issues arising with any party wall documentation. So it is in their interests to ensure that every aspect is meticulously taken care of on your behalf.

To allow sufficient time for all the necessary party wall matters to be completed ahead of works commencing, you are best advised to appoint your party wall surveyor in East London a good three months before the start date of your building works.

A Party Wall Award is a legal document designed to protect both parties’ property and rights. It records the nature of the works, how and when they should be carried out, and how much will be paid.

The Party Wall Award also includes a Schedule of Condition. This is a factual record of the condition of a property, detailing specifically the affected parts of the adjoining property ahead of works commencing.

Whilst a Party Wall Award is a necessity should a dispute arise, it is also a voluntary option for building owners looking to reduce risk and avoid any future disagreements by having everything documented.
