Do I definitely need a Party Wall Agreement?

If you are undertaking work to an existing party wall or shared structure, including a chimney; you intend to build on or close to the boundary line; you are excavating within three metres of a building or structure, or are building further away but excavation is still required, then the Party Wall etc. Act 1996 is likely to come into play and you will need to follow statutory procedure.

Whilst the Party Wall Act does not contain enforcement procedures if you fail to serve notice on adjoining owners, if you commence work without the consent of a neighbour, then they may take action to halt your work through a court injunction or other legal channels. So you really are best advised to take advice before you start.

If you opt to self-file your Party Wall Notice, or use an unregulated party to take care of this important procedure, you are effectively risking spending more money if the notices are incorrectly issued and need to be corrected. The fact is that most self-filed notices will carry some form of inaccuracy, which translates as a false economy.

Party wall surveyors who are accredited by the Royal Institute of Chartered Surveyors (RICS) are liable for any issues arising with any party wall documentation. So it is in their interests to ensure that every aspect is meticulously taken care of on your behalf.

To allow sufficient time for all the required party wall matters to be completed before the works start, you are well advised to appoint your party wall surveyor in South East London at least three months before the start date of your building works.

Do bear in mind though that a Party Wall Agreement generally only lasts 12 months from the date of the Party Wall Award, so you will need to avoid delaying the start of the works once all the paperwork is in hand.

If you have been served a Party Wall Notice, your party wall surveyor will review the notice and supporting documents, and guide you on your options. If you wish to oppose the plans, the surveyor will represent you to ensure you are protected against costs and damages in relation to the works.

A Party Wall Award is a legal document designed to protect both parties’ property and rights. It records the nature of the works, how and when they should be carried out, and how much will be paid.

The Party Wall Award also includes a Schedule of Condition. This is a factual record of the condition of a property, detailing specifically the affected parts of the adjoining property ahead of works commencing.

Whilst a Party Wall Award is a necessity should a dispute arise, it is also a voluntary option for building owners looking to reduce risk and avoid any future disagreements by having everything documented.
