What is a Party Wall Notice?

A Party Wall Notice is a formal communication issued by a building owner or the appointed Party Wall Surveyor to adjoining owners as per the requirements of the Party Wall Act. It serves as a notification of the building owner’s intention to carry out specific works that may affect the shared party wall or structure between the properties. The Party Wall Notice outlines the proposed works, the anticipated start date, and the potential implications for the adjoining owners.
When an adjoining owner receives a Party Wall Notice, they have three options to consider and respond:

Consent to the Party Wall Notice.

The first option for the adjoining owner is to provide written consent to the building owner’s Party Wall Notice. By giving consent, the adjoining owner acknowledges and agrees to the proposed works, relieving the building owner of any further legal obligations.

Dissent and appoint a Party Wall Surveyor

The second option for the adjoining owner is to dissent from the Party Wall Notice and appoint their own Party Wall Surveyor or use the same Surveyor also known as an Agreed Surveyor. This ensures that their interests and concerns are protected throughout the process. The appointed Party Wall Surveyor will agree on a Party Wall Award, which is a legally binding document that sets out the rights and obligations of both parties regarding the proposed works.

Do nothing and be deemed to dissent:

The third option for the adjoining owner is to not respond to the Party Wall Notice within the specified timeframe. In such cases, the adjoining owner is deemed to dissent, triggering the appointment of a Party Wall Surveyor by the building owner. This option is not recommended, as it removes the control and involvement of the adjoining owner in the process, potentially leading to disputes and delays.

    Common Foundation Types

    Strip Foundation

A strip foundation is a shallow foundation used in construction to support the load of a structure. It consists of a continuous strip of concrete placed in a trench along the building’s perimeter. Strip foundations are commonly used in residential construction, particularly for houses and low-rise structures, providing stability for load-bearing walls and transferring weight to the soil. They are suitable for stable soil conditions with sufficient bearing capacity and uniform ground conditions. Strip foundations offer cost-effectiveness compared to deep foundation systems, making them ideal for straightforward building designs. Consulting with a qualified engineer or foundation specialist is crucial to determine the most suitable foundation type for a rear extension project, considering local codes and specific requirements.

    Heading – Eccentric Foundation

An eccentric foundation, similar to a strip foundation, is a shallow foundation used in construction to support the load of a structure. It consists of a continuous strip or beam of concrete placed in a trench along the building’s perimeter. Eccentric foundations, like strip foundations, are commonly employed in residential construction, specifically for houses and low-rise structures. They play a vital role in providing stability for load-bearing walls and effectively transferring the weight to the soil. These foundations are well-suited for stable soil conditions that possess sufficient bearing capacity and exhibit uniform ground characteristics. The use of eccentric foundations is advantageous due to their cost-effectiveness when compared to deep foundation systems. This makes them particularly suitable for straightforward building designs. To determine the most appropriate foundation type for a rear extension project that involves eccentric foundations, it is crucial to consult with a qualified engineer or foundation specialist who can account for local codes and specific project requirements.

What is the Party Wall Act?

A law in the UK that governs building works affecting party walls, boundaries, and adjacent properties.

It depends on various factors, such as the type of extension and its proximity to the party wall. Consult a Party Wall Surveyor to determine if an agreement is required.

The building owner must serve a written notice to the affected adjoining owners, providing details of the proposed works and complying with the legal requirements of the Party Wall Act.
Here at Icon Surveyors, both our Building Owner Party Wall Surveyor and Agreed Party Wall Surveyor jobs are competitively priced at a fixed cost.

You can consent to the works, dissent and appoint a Party Wall Surveyor, or do nothing and be deemed to dissent.

It is a legally binding document prepared by Party Wall Surveyors, outlining the rights and responsibilities of both the building owner and adjoining owner(s) regarding the proposed works.

No, it is a legal requirement to serve a Party Wall Notice if the works fall within the scope of the Party Wall Act. Failure to comply can lead to legal consequences.

The timeframe can vary depending on the complexity of the project and the cooperation between parties. Generally, it can take several weeks to a few months.

If the parties cannot reach an agreement, the appointed Party Wall Surveyors will resolve the dispute through the preparation of a Party Wall Award, which is legally binding.
